Terms and Conditions Lublin

Terms agreed between the company „FluoSpot Sp. z o.o.” (hereinafter referred to as the “company,” “organizer” or “Pigcasso”), registered under NIP: 7123471924, REGON: 528005750, based in Lublin:

and the service recipient, hereinafter referred to as the “user,” “participant,” or “guest.”

PRELIMINARY PROVISIONS

  1. These Terms and Conditions specify the terms of service provided by „FluoSpot sp. z o.o.” (hereinafter referred to as the “organizer” or “Pigcasso”), registered under NIP 7123471924, REGON 528005750, with headquarters in Lublin, at Borelowskiego 2F/2, to the service recipient, hereinafter referred to as the “Participant.”
  2. The Participant is required to read the Terms and Conditions and share the information contained within with any other individuals who will be using the services provided by the organizer.
  3. The Participant is obliged to use the Website and the services provided by the organizer in accordance with these Terms and Conditions, applicable laws, and principles of social coexistence.

GENERAL TERMS OF SERVICE

  1. At Pigcasso, services are provided to both individual clients and organized groups, but under different conditions, described in these Terms and Conditions in the section “Service Booking for Organized Groups.”
  2. Services provided by the organizer consist of granting access to painting tools in the style of action painting in one of the painting rooms, using three types of techniques:
    • splashing,
    • manual tables,
    • electric tables.
  3. The service is provided in a session-based system. Each session lasts 60 minutes and cannot be extended.
  4. Services are offered in two session types:
    • regular session where participants paint with poster paints,
    • fluo session where participants paint with poster paints that glow under UV light.
  5. Only one technique, selected during booking, can be used per session. 
  6. Services require a ticket in advance.
  7. Types of tickets:
    • discounted ticket,
    • discounted ticket + additional person / guardian,
    • regular ticket,
    • regular ticket + additional person.
  8. A discounted ticket is available for people under the age of 18 upon presentation of a valid school ID, seniors, and people with disabilities – upon presentation of documentation confirming eligibility.
  9. A ticket type with the note “+ additional person” allows two people to use one station with the selected technique.
  10. Only persons over the age of 3 may use the services or be present in the painting rooms.
  11. Children under 12 may use the services only if accompanied by an adult (hereinafter referred to as the guardian), who must remain with the child in the painting room for the entire duration of the service
  12. One adult may supervise a maximum of 5 children in the room.
  13. A maximum of 2 people may be at one workstation, including the guardian.

SERVICE BOOKING

  1. Services by the organizer are available only with prior reservation made via the Website.
  2. After booking, the participant receives a confirmation email to the address provided during booking.
  3. Without a reservation, the organizer may refuse access to the service.
  4. Reservations can be rescheduled by phone or in person at the venue.
  5. Reservations can be canceled through the confirmation email, by phone, or in person.
  6. Cancellation or rescheduling must be done no later than 48 hours before the reservation time.
  7. Participants are entitled to a refund only if the reservation is canceled at least 48 hours in advance.
  8. After canceling a reservation, to receive a refund, the participant must send an email to lublin@pigcasso.pl with a refund request and include the bank account number for the refund.
  9. Failure to send the email mentioned in point 8 will result in the inability to process the refund.

PAYMENT FOR THE SERVICE

  1. Payment can be made:
    • during the booking process via online payment system;
    • on-site on the day of the reservation:
      • in cash
      • by debit/credit card,
      • with a Pigcasso gift voucher,
      • by bank transfer – with a deferred invoice (only for companies).
  2. An invoice can be issued if the Pigcasso staff is informed on the day of the reservation. 

PIGCASSO GIFT VOUCHERS

  1. Pigcasso gift vouchers allow the holder to use the service with any technique, session type, and date, after prior booking through the Website.
  2. Gift vouchers can be purchased on-site during opening hours or online via email at lublin@pigcasso.pl.
  3. Gift vouchers match the types of admission tickets available and entitle the user to the same service.
  4. To use the voucher as payment, select “Voucher” as the payment option during booking.
  5. To use the booked service via voucher, the printed paper version of the voucher must be given to staff before the painting session.
  6. Failure to present the printed paper version entitles the organizer to refuse service.
  7. The voucher is valid for 6 months from the date of purchase and cannot be extended.

SERVICE PROCEDURE AND SAFETY RULES

  1. Before the session, Pigcasso staff will explain the service rules and safety instructions.
  2. The paints provided are poster paints that have passed safety tests showing they are non-toxic. Detailed composition and safety certificates are available upon request.
  3. Each participant receives a disposable protective outfit suited to the selected technique and a pair of shoe covers. The organizer is not responsible for any damage or staining to clothing or shoes.
  4. Each participant receives a 40×50 cm canvas, a set of paints, and painting tools. Additional paints or larger canvases can be purchased on-site, and canvas size can be upgraded for a fee.
  5. Canvas upgrades are not available for manual or electric table techniques.
  6. Participants must arrive at the venue 15 minutes before their booked time.
  7. If a participant arrives more than 15 minutes late, the organizer may refuse service.
  8. After the session, the participant receives their artwork in packaging suitable for transport. The organizer is not responsible for any damage to the artwork during transport.
  9. Each participant is required to take home the painting they created at Pigcasso. This rule does not apply to artworks created on canvases larger than 40×50 cm, which must be left at Pigcasso to dry and picked up at a time agreed upon with the organizer.
  10. If a painting is left with the organizer, the participant automatically waives all ownership and copyright claims to it. This does not apply to the exception mentioned in point 9, second sentence.
  11. During the service, participants must exercise with caution and avoid sudden or excessive movements that could lead to injury to themselves or others.
  12. Lockers with keys are available. The organizer is not liable for damaged, lost, or stolen items brought into the painting rooms.
  13. In case of an accident or sudden illness, participants must immediately notify staff.
  14. The organizer may refuse service to anyone under the influence of alcohol or drugs.

SERVICE RESERVATION FOR ORGANIZED GROUPS

  1. The Organizer allows organized groups to use the services under the terms described in the following sections, as well as in the chapters titled “Birthday Party” and “School Trip.” In matters not regulated in these sections and chapters, the provisions applicable to individual customers shall apply.
  2. Within the scope of service reservations for organized groups, the following are distinguished:
    • Birthday party,
    • School trip.
  3. Service reservations for organized groups can be made by phone, email, or in person at the venue.

BIRTHDAY PARTY

  1. The birthday party at Pigcasso lasts 2 hours and consists of two parts:
    • Painting in the session and technique chosen by the participant booking the birthday party,
    • Animation combined with free time for birthday participants in the birthday room
  2. .The organization of a birthday party is only possible for persons over 5 years of age.
  3. Painting during the birthday party using hand tables or electric tables is only allowed for persons over 10 years of age, and this requirement applies to all participants of the birthday party.
  4. If even one participant of the birthday party is under 12 years old, a responsible adult must stay with them on the premises.
  5. The minimum number of birthday party participants is 10 persons.
  6. During the birthday party, the participant is provided with access to the birthday room.
  7. The total cost of the birthday party depends on the number of participants who actually attended and participated in painting during the party. However, if fewer than 10 people attend the birthday party, the cost will be charged as if 10 people were present.
  8. After booking the birthday party, the participant will receive a confirmation email at the address provided.
  9. When booking a birthday party, the participant is required to pay a deposit of 300 PLN to the bank account provided in the email mentioned in paragraph 8.
  10. The participant has 3 days from the moment of booking to make the deposit payment and send the payment confirmation by email. If this is not done, the organizer will cancel the birthday reservation.
  11. The birthday party can be effectively canceled or rescheduled no later than 72 hours before the scheduled start time.
  12. In case of an unsuccessful cancellation, the deposit paid according to the rules in paragraph 9 is non-refundable.

SCHOOL TRIP

  1. The school trip at Pigcasso lasts 60 minutes and consists of painting in the session and technique chosen by the participant booking the school trip.
  2. The organization of a school trip is only possible for persons over 3 years of age.
  3. If even one participant of the school trip is under 12 years old, a responsible adult must stay with them on the premises.
  4. Painting during the school trip using hand tables or electric tables is only allowed for persons over 10 years of age, and this requirement applies to all participants of the school trip.
  5. The total cost of the school trip depends on the number of participants who actually took part in the painting during the school trip. However, if fewer than 10 people attend the school trip, the cost will be charged as if 10 people were present.

PERSONAL DATA PROCESSING

  1. The personal data provided by the participant are collected and processed by the company “FluoSpot sp. z o.o.”
  2. By using the service, the participant consents to the processing of the personal data provided during the booking and the service. This consent constitutes the basis for personal data processing. The personal data are processed in connection with the service execution and participant communication with the staff.
  3. Statements regarding personal data may be revoked by the participant at any time, verbally, by sending information to the email address lublin@pigcasso.pl, or in writing to Pigcasso’s registered office address.

FINAL PROVISIONS

  1. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code shall apply
